The House Energy and Commerce Committee is expected to pass legislation later this week to repeal a key protection for people who access health care or long term services and supports through Medicaid. The Affordable Care Act includes an important provision that prohibits states from reducing their Medicaid eligibility levels or changing the rules to make it harder for people to enroll in Medicaid. This protection is referred to as the “maintenance of effort,” or MOE, requirement. H.R. 1683 would repeal this important provision. The Arc opposes the repeal. It is important to maintain health insurance coverage as the states and federal government implement health care reform. The MOE provisions provide critical protections to children, people with disabilities and older Americans.
